Every licensee is subject to disciplinary action if: They refuse to perform the licensed activity, aids or incites the refusal to perform that licensed activity by another licensee or they make any discrimination or restriction in the performance of licensed activity. Architectural barriers to an individual with physical disabilities that conform to applicable state or local building codes & regulations shall not constitute as discrimination. True A licensee does not have to permit a person to participate, benefit from licensed activity if they: Pose a direct threat to the health & safety of others that cannot be eliminated by modifications of policy, practice or procedure, or by the provision of auxiliary aids or services. The offer, delivery, receipt, or acceptance by any licensee under this division or the Chiropractic Initiative Act of any rebate, refund, commission, preference, patronage dividend, discount, or other consideration, whether in the form of money or otherwise, as compensation or inducement for referring patients, clients, customers to any person, irrespective of any membership, proprietary interest, coownership in or with any person to whom these patients, clients or customers is: Unlawful Payment or receipt of consideration for services other than the referral of patients based on a percentage of gross revenue or similar contractual arrangements: Shall NOT be unlawful IF the consideration is commensurate with the value of services furnished or with fair rental value of premises or equipment leased or provided by the recipient to the payer. Health care facility means: General acute care hospital, skilled nursing facility, intermediate care facility, and any other health facility licensed by the State Department of Public Health.
