Bill Summary
⮚The Overdose Prevention and Patient Safety Act is a bill which aims at
putting patient safety to a robust level.
⮚Its primary goal is protecting patients’ confidentiality and their medical
records. It thus intends to amend the Public Health Service Act in order to
achieve its goal.
⮚It was introduced to Congress on 3rd April, 2019. It is sponsored by Earl
Blumenauer, Oregon’s third congressional district representative.

Merits
❖The bill, like any other, has certain merits and demerits in areas it affects.
❖Some of the benefits include strengthening accountability and health insurance
for the purposes of payment, treatment and other health care operations.
❖It furthermore eases the restrictions on the sharing of patients’ health records
with addictions. This intends to ensure safety of the patient since
inappropriately sharing their health records would detriment their healthcare
safety.

❖The bill ensures avoiding of disclosure of patients’ health records with substance
use disorder without medical staff’s written consent. It thus improves the
patient safety ensuring that no research or such other evolutions would be done
using the patient’s records without getting a consent from a medical staff.
❖This bill would allow better decisions in understanding potential consequences
of accessing patients’ records since the doctors would make better informed
decisions than just allowing patients to do that on their own.
Merits continuation
❖The bill, moreover, ensures that criminal penalties for substance abuse
disorder records violations would support the structure of HIPAA.
❖This bill will also enhance privacy and thus prohibit the use of SUD
information in civil and criminal prosecution. The patients are thus
protected against discrimination caused by sharing of medical information
to with landlords and employers of the substance abuse patients.
