RAICH 2 Parties There are two different parties being described in this case. The first party is known as the plaintiff an that will be Angel Raich. The second party being presented in this case is the Attorney General who happens to be Alberto Gonzales. Facts This case has a few known facts that cannot be ignored. The first known fact is that Angel Raich is a California resident that was legally prescribed the usage of marijuana to treat numerous of medical conditions by her doctor. Raich was growing marijuana plants at home which is legal in the eyes of California state, but on the federal side of the law it is seen as a violation of Controlled Substance Act. According to Find Law, “In 1913, California was one of the first States to prohibit the sale and possession of marijuana, and at the end of the century, California became the first State to authorize limited use of the drug for medicinal purposes” (para.7). This shows individuals how the times have changed over the decades. California became one of the first states to officially legalize marijuana as well. Procedure Riach took legal action against the US Attorney General and the Drug Enforcement Administration. She took upon herself to file a motion for a preliminary injunction which was deny by the District Court eventually. Surprisingly, a divided panel from the Court of Appeals of the Ninth Circuit had overturn the ruling of the District Court an allow the preliminary junction to take place. Gonzales took this matter to the Supreme Court and the ruling the Ninth Circuit was appealed.
