a. Computer Fraud and Abuse Act of 1986
i. The Computer Fraud and Abuse Act (CFAA) was enacted in 1986. It was
the made as an amendment for the first federal computer fraud law. The
CFAA was created to protect classified information, financial records, and
credit information on the government and financial institutions. However
there are some problems with the law. It doesn’t clearly define
authorized users, so when an officer used his ran a plate after he was
bribed. He was arrested and was charged with breaking the CFAA.
However he claimed he was authorized to use this information.
b. National Information Infrastructure Protection Act of 1996:
The National Information Infrastructure Protection Act(NIIPA) was
enacted to help the federal government coordinate all different senders,
channels, and receivers. This act altered the CFAA. It further expanded
the protections of the CFAA. It extended protection to foreign and
interstate commerce and communication. This act also focused on
privacy. It made the penalties harsher on illegal obtained government
information.
c. USA PATRIOT Act of 2001
i. The USA Patriot Act was one of the most important computing legislation
put into law. It was focused around 9/11 to prevent future terrorists
attacks. Basically, the we give up some of our rights of privacy to allow the
government to have the tools to prevent a terrorist attack.
d. Federal Privacy Act of 1974
The Federal Privacy Act or the Privacy Act was made to reduce the
collection of private information. It prevented improper disclosure. This
was put into place to put a check on the government, and insured
peoples privacy.
e. Electronic Communications Privacy Act of 1986
The Electronic Communication Privacy Act(ECPA) was an upgrade from
the previous law, which was the Omnibus Crime Control and Safe Streets
Act(OCCSSA). The OCCSSA was created to protect the privacy of
communication over phone and in person. The ECPA was created to
protect communications electronically. Specifically, it protected email,
computer data transmissions, faxes, pagers, and cellular and cordless
phones.
f. Health Insurance Portability and Accountability Act of 1996 (HIPAA),
The Health Insurance Portability and Accountability Act(HIPAA) was
created to ensure privacy and protection of personal records and data.
This means this information cannot be disclosed with others unless the
individual has given permission.
