According to Title VII of the Civil Rights Act of 1964 “unwelcome sexual advances, requests
for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual
harassment when this conduct explicitly or implicitly affects an individual's employment,
unreasonably interferes with an individual's work performance, or creates an intimidating,
hostile, or offensive work environment” (Eeoc.gov, 2019). Based on this act, I would say that
me or my co-workers have grounds for a legal complaint against the surgeon. No one should
ever have to go to work and feel uncomfortable because of other people’s comments or
actions. I would definitely encourage my coworkers to take advantage of the policies and
procedures in place to report these types of incidents. I do not think they have grounds for
legal complaints against the hospital at this time. However, if they had filed a complaint and
nothing was done about the situation then I would say they could file a complaint against the
hospital. I believe the surgeon's actions are unethical and do not meet the legal standard. If the
surgeon is okay with sexually harassing coworkers, then who is to say that they are not going
to sexually harass a patient as well. This kind of behavior is a legal liability for the hospital
and should be handled immediately.
