This law applies to all schools that receives funding from the United States Department of Education. FERPA also gives parents certain rights as well, these rights transfer to students wants they are of age which is 18 years old.First step: Identifying A Child Need  “ There are several children that may or may not be diagnosed with a disability by there school district provider or a medical provider, however, one must understand that being diagnosed with a disability is not a guarantee of services under the IDEA (IDEA(2004)”.  Questions that’s often ask:  Does your child have a Disability?  Do your child qualifies?  Does your child’s disability affect his or her educational progress?  Does your child need particularly designed instructions?Special Education Eligibility  Learning Disability  Mental Retardation  Autism  Physical sensory disability  Emotional DisturbanceStep Two: Formal Assessment  if your child has not responded to or at the same level as children at the child's age it may be time to evaluate for a learning disability or other delays.Types of Assessments  Observation  Record of Portfolio review  Testing  Recollection  Interviewing or rating scalesStep Three: The individualized Education Program and Meeting  If your child is diagnosed with a learning disability or impairment the next step is the draft of an individualized education program which is also called (IEP). According to The Individuals with Disability Education Act (IDEA) “it gives school districts 30 days from the documentation of the disability to complete an IEP and parents must be given permission and notified and given placement as apart of the plan (IDEA. 2004)”.
