LEGAL/ETHICAL ISSUES 2 Drug Diversion Among Healthcare Workers (HCW's) Jeopardizes Patient Safety Delivering efficient, safe, quality care is vital to maintaining patient safety for healthcare organizations. There are ethical principles in nursing that guide practice, the first one being nonmaleficence, which means to "do no harm" (Silva & Ludwick, 1999). Studies show that during an HCW's career, approximately 10 -15% will experience substance abuse at some point (Schub & March, 2018). The topics discussed throughout this paper include the legal and regulatory issues of drug diversion among nurses, the steps required to investigate reported alleged chemical impairment of staff, and the Virginia Department of Health Professions (VDHP) recovery program available for licensed personnel. Further discussion will detail efforts to improveboost the safety and quality of care delivered as well as the cost associated with drug diversion and how it affects patient safety, followed by concluding statements highlighting the main points discussed in this paper. Addressing Legal/Regulatory Issues Major regulatory and legal issues such as drug diversion are problematic for many healthcare facilities today. As a result of drug diversion, the victimization of patients is evident through fraudulent documentation in the medical record, violation of the patient's right to pain control, medication errors, and poor quality care (Mumba, 2018). Preventing drug diversion requires vigilance and a robust prevention program comprised of three crucial elements, including prevention, early detection, and the proper response (Ward, 2019).
