And for criminal acts that may have used any type of digital technology this is no different. But the caveat to digital evidence is that there is always more than meets the eye. For example, in a murder using a knife, an investigator will use the presence of the bloody knife as evidence, but for child pornography case an investigator would look for hard drives, and would be unable to tell whether or not they even contain pornographic material until further examinations can be done. In this regard there are many issues pertaining to the seizure of an item they are not sure was even used in the crime. One of the main arguments is the inherent right to privacy given by the 4th amendment of the constitution, and its protection against unreasonable searches and seizures (Hagen 2015). For a search and seizure to even happen the investigating body must claim a probable cause. The concept of probable cause is good and all, but dealing with digital evidence. A professor Orin Kerr not only argued that applying the 4th amendment to digital evidence is not only troublesome, he also compared it to searching for a needle in a haystack (Bartholomew 2014).
