Florida's abortion laws area bit more restrictive than those enforced in many other states. As of 2013, a law was passed requiring all doctors who perform an abortion to offer emergency medical care if the baby is somehow born alive due to a possible failed abortion. Should this law be violated it is then considered a first-degree misdemeanor which carries a sentence of up to a year in jail as well as a one thousand dollar fine for the Doctor. Healthcare practitioners, as well as employees of hospitals, physicians offices and abortion clinics, must report all known violations to the Department of Health (FindLaw, 2016). In the state of Florida, the penalty an unlawful abortion is a Third-degree felony; imprisonment to 5 yrs. or 2nd degree misdemeanor; up to 60 days imprisonment for performing abortion in unlawful place; Fines: 3rd degree felony, up to $5,000; 2nd degree misdemeanor, up to $500 (FindLaw, 2016). The definition of an illegal abortion is considered Termination of pregnancy during last trimester which does not meet requirements of legal abortion.
