Appointment of Notaries Public - ☑☑The Secretary of State may appoint and commission as many persons as he considers necessary, who are citizens of this state and are over the age of eighteen. ... Certificate of Qualifications - ☑☑Before the appointment of a notary public is made, the applicant shall produce to the Secretary of State a certificate from a judge or justice of the court of common pleas, court of appeals, or supreme court that he is of good moral character and a citizen of the county in which he resides. Notary term - ☑☑Five years unless you're an attorney- at which they hold as long as needed. Seal requirements - ☑☑All notaries must have a seal that includes the following: 1. One inch diameter circle with the words "Notary Public or Notarial seal. 2. Name of the notary public 3. State of Ohio * Can either be stamped or embossed Jurisdiction Powers - ☑☑All may be completed within the state of Ohio: 1. Administer oaths required or authorized by law 2. Take and certify depositions 3. Take and certify acknowledgments of deeds, mortgages, liens and POA's- as well as other instruments of writing 4. receive, make, and record notarial protests Notary Fees - ☑☑1. $1.50 per signature on AFFIDAVITS 2. $2.00 per signature on ACKNOWLEDGEMENTS Can you notarize a document if you know your commission is expired? - ☑☑No, any person who performs this act knowingly, shall forfeit nor more than five hundred dollars and will be ineligible for reappointment. What happens if you charge over the $1.50-$2.00 fees? - ☑☑Upon investigation, the Court of Common Pleas will complete the removal and the person will be ineligible for reappointment. What happens if you perform a notary with stating the oath? - ☑☑A notary public who violates this section shall be remove from office by the Court of Common pleas and the person will not be eligible for reappointment for three years.
