Ohio, 2005-Ohio-1295 HC260 The question that was originally brought to the courts in regards to Briefing on (Fiske v. U.S. Health Corp. of S. Ohio, 2005-Ohio-1295 , 2005), is: Was the hospital, Sothern Ohio Medical Center, and the doctors Dr. Robert Dale and Dr. Richard Rooney, negligent in the treatment of Mr. William Fiske and did they discriminate against Mr. William Fiske because he is HIV positive? In February of 1993 Mr. William Fiske, the Plaintiff-Appellant, went to the emergency room at Southern Ohio Medical Center, with the complaint of severe abdominal pain. Mr. Fiske informed the health care staff who was taking care of him that he was HIV positive. Some procedures were performed in the emergency room and Mr. Fiske was assessed by Dr. Robert Dale, the emergency room physician. Dr. Dale informed Mr. Fiske that he may be suffering from appendicitis and recommended that Mr. Fiske be examined by the on-call surgeon, Dr. Richard Rooney. It is believed that Dr. Rooney refused to examine Mr. Fiske because he was HIV positive. Approximately 9 hours after Mr. Fiske arrived at the emergency room he was then transported at his own expense, to another hospital.
