Due process ensures that a citizen's individual rights are protected, and any criminal case will be handled with fairness and equity (Schmalleger, 2020).Due process is what protects the ordinary citizen from being treated unfairly in any legal situation whether it isthe ability to work or marry and the right to raise ones children. It this process that allows every person guilty or innocent the right to a fair trial. Ramraj(2004) defined it perfectly, "A constitutional due process guarantee defines and limits the state's ability to deprive a person of life or liberty and ensures that any state-ordered execution or detention is duly authorized by law (p.1)." Due process is such a central notion in American criminal justice largely because the American people realized the importance of every citizen being afforded basic fairness in a criminal or civil matter. America is known for its freedom to pursue life, liberty, and happiness. Due process has been the standard model for daily practice in the American criminal justice system since the 1960s (Schmalleger, 2020).
