This makes for complicated situations when trying to take a criminal to court in order to hold them accountable for their crimes. State and federal extradition laws come into play as well as treaties and international law. In some instances police apprehend a person on suspicion of criminal activity however, the evidence against that person is insufficient to hold them in custody for more than a temporary period of time. To prevent the unlawful detention of individuals without evidence of criminal activity the United States of America adopted what is called the writ of habeas corpus. The following is an analysis of a bank robbery scenario in order to better understand the rules surrounding extradition and habeas corpus. Brook and his friend Hurst decided to rob the First National Bank located in Newport Beach, Orange County, California. After the robbery both individuals fled to Nogales, Arizona, where they divided the money and went their separate ways. Brook fled to Mexico however, Hurst stayed in Nogales and where he met a friend named Solana. Based on a tip, the officers from the Nogales Police Department arrested Hurst and Solana booking both on suspicion of bank robbery.
