This paper talks about due process being a central notion in the criminal justice system. What is due process? Due process means to be treated equally and fairly. It also means you have rights that need to be upheld. The due process standard is that if criminal defendants rights are not upheld then it could be grounds for dismissal of evidence or criminal charges in court proceedings (Schmalleger, 2018). Due process utilizes the first 10 amendments to the constitution which are also known as the bill of rights and came into play after court proceedings in the 1960s by the Warren courts. The Warren courts ruled that rights mattered after several cases of rights being violated came into play. Due process protects our 4th, 5th, 6th, and 14th amendment rights. The 5th amendment specifically refers to our right to due process. Due process is a safeguard from arbitrary denial of life, liberty, and property by the government outside the sanction of the law (Meyers, 2018).
