CJ227_Unit_6_Assignment.docx Unit 6 Assignment Purdue University Global Unit 6 Assignment Often times multiple individuals are arrested on suspicion of, and charged with committing the same crime or crimes. These crimes often occur when gang activity is involved. In order to better understand the criminal procedure that occurs during these and other cases we must understand what happens during the pretrial hearings. This includes pretrial discovery, motions, and the roles and responsibilities of both the defense and prosecuting attorneys. The following is an analysis of a case where three defendants are suspected of committing three separate assaults and rapes of juveniles over a 3-day period. One of the defendants, Bert, tells his defense attorney that he did not commit any of the rapes. He admits that he was only present during one of the incidents with Jones and all he did was hit one of the girls. Berts attorney then submits a motion for severance of defendants in the case. â€œThe laws of most states hold that when two or more defendants are jointly charged with the same offense, they must be tried jointly unless the judge feels that in the best interest of justice separate trials should be granted (Roberson & Winters, 2020, p. 210).â€ However, some evidence presented in trial may only be applicable to certain individuals and not to others. If a jury sees this evidence they could use it as prejudice against one or all of the defendants.
