This new sweater line can withstand temperatures that are thirty below zero. She will model at the Eastern Hotel where many celebrities and individuals that are connected to the fashion industry will be attending. Clad, what she is wearing, is a stylish skirt with four-inch heels and the green Naturally There sweater. Candie walks to the end of the walkway where there was a small wrinkle in the carpet. Her heel caught the wrinkle in the carpet, and she tripped and fell onto the row of judges in front. One world renowned model, Myra, suffered a broke nose and a cut to her face. She also wants to bring a lawsuit to of negligence to CARDWARE and Candie. For Myra to bring a lawsuit to court for negligence, she would have to prove the following: duty, breach, causation, and damages. In negligent cases, “The outcome depends on how the judge (or jury, if is a jury trial) decides a reasonable person in the position of the defendant would act in the particular circumstances of the case.”(Miller, 2012, p.78) In this case, the jury needs to ask how a reasonable person would act in the certain circumstance.
